Under Finnish law, spouses own their own property separately. However, a marital right (avio-oikeus) means that on divorce or death, each spouse has a right to half of the other's property. A prenuptial agreement can exclude this right wholly or in part.
A prenuptial agreement has significant implications for inheritance. It affects how much a surviving spouse receives from the estate and how the inheritance is distributed. We always analyse these effects before the agreement is signed.
